Terms of Service

These Terms of Service govern the agreement between Heritage Brickworks LTD, trading as Heritage Brickworks ("we", "us", "our"), and you, the client. By accepting a quotation and instructing us to commence work, you agree to be bound by these terms.

1. Quotations, Estimates and Site Surveys

All site surveys and initial consultations are provided in good faith. Quotations are valid for 30 days from the date of issue. An estimate is a calculated guess of the likely cost and is subject to change if unforeseen circumstances arise. A quotation is a fixed price for the specific works detailed within it.

2. Payment and Deposits

We may require a deposit prior to the commencement of work, particularly where bespoke materials, reclaimed bricks, or custom lime mortars need to be ordered. Payment schedules will be clearly defined in your quotation. Final payment is due upon completion of the agreed works, unless otherwise specified.

3. Heritage, Listed Buildings, and Conservation Approvals

It is the absolute responsibility of the client to ensure that all necessary planning permissions, listed building consents, and conservation officer approvals have been obtained prior to the commencement of any work. Heritage Brickworks will work strictly to the approved specifications but accepts no liability for works undertaken without the correct legal consents in place.

4. Material Variations and Heritage Matching

"Traditional materials naturally vary in colour, texture and finish. Heritage Brickworks will always aim to achieve the closest possible match appropriate for period properties."

Due to the nature of traditional craftsmanship, reclaimed bricks and custom lime mortars will inevitably exhibit slight variations. Furthermore, lime mortar requires specific environmental conditions to cure correctly. While we employ expert techniques, curing times may vary, and clients are advised not to subject newly laid lime mortar to extreme temperatures or direct impacts.

5. Site Conditions, Access, and Delays

We require reasonable access to the site to execute our work efficiently. Work on existing structural conditions may uncover hidden defects; any variations to the work required will be discussed and agreed upon before proceeding. We are not liable for delays caused by extreme weather (which can severely impact lime mortar work), delays in sourcing bespoke heritage materials, or acts beyond our reasonable control.

6. Waste Removal and Site Cleanliness

We pride ourselves on maintaining a clean and safe working environment. Unless explicitly stated otherwise in the quotation, waste removal related to our specific operations is included. However, we do not remove general site waste unrelated to our brickwork and masonry services.

7. Liability, Insurance, and Guarantees

We hold comprehensive public liability insurance. We guarantee our workmanship for a period agreed upon in your contract, subject to fair wear and tear and proper maintenance by the client. We cannot guarantee existing structural elements or materials provided by third parties. Our liability is strictly limited to the value of the services provided.

8. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
